1. Acceptance of Terms

By accessing or using the Postnatal Recovery website and program (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.

2. Description of Service

Postnatal Recovery is an online postnatal exercise program consisting of 56 video sessions across 8 weeks, plus bonus content. The Service includes:

• Access to exercise video content
• An initial health and wellness assessment
• Progress tracking and achievement badges
• Educational health and fitness information

The Service is for educational purposes only and is not a substitute for professional medical advice. Please read our Medical Disclaimer carefully.

3. Your Account

To access the program, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

You must be at least 18 years old to create an account and use the Service.

4. Payment and Pricing

The Service is available as a one-time purchase with 6 months access. All prices are displayed in Australian Dollars (AUD) and include GST where applicable.

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service.

5. Refund Policy

We offer a 14-day money-back guarantee from the date of purchase. If you are not satisfied with the Service for any reason, you may request a full refund within 14 days of your purchase date.

To request a refund:

• Email hello@postnatalrecovery.com.au with your account email and reason for the refund
• Refunds are processed within 5-10 business days to your original payment method

This refund policy is in addition to your rights under the Australian Consumer Law. Nothing in these Terms limits or excludes any consumer guarantees under the Competition and Consumer Act 2010 (Cth).

6. Licence and Intellectual Property

Upon purchase, we grant you a non-exclusive, non-transferable, personal licence to access and view the program content for your own personal, non-commercial use.

You may not:

• Copy, reproduce, distribute, or publicly display any program content
• Download, screen-record, or otherwise capture video content
• Share your account credentials with others
• Use the content for any commercial purpose, including reselling, teaching, or creating derivative works
• Attempt to reverse-engineer, decompile, or extract source code from the Service

All content, including videos, text, graphics, logos, and software, is owned by Postnatal Recovery and protected by Australian and international copyright law.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorised access to other accounts or systems
• Upload malicious code, viruses, or harmful content
• Impersonate another person or misrepresent your affiliation

8. Health and Safety

You acknowledge and agree that:

• The Service provides general health information and is not medical advice (see our Medical Disclaimer)
• You are responsible for obtaining medical clearance before starting the program
• You participate in exercises at your own risk
• You will stop exercising and seek medical advice if you experience pain or unusual symptoms

9. Limitation of Liability

To the maximum extent permitted by law, Postnatal Recovery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid for the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law, including liability for death or personal injury caused by negligence.

10. Termination

We may suspend or terminate your access to the Service if you breach these Terms. Upon termination:

• Your right to access the program content will cease
• We may delete your account and associated data after 30 days
• Provisions regarding intellectual property, limitation of liability, and governing law survive termination

You may delete your account at any time through the profile settings or by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect.

Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Western Australia.

Before commencing legal proceedings, you agree to attempt to resolve any dispute by contacting us and engaging in good-faith negotiations for at least 30 days.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
